Letter to the Government of the Republic of Croatia
Request for the establishment of a model for regulating sex work.
Introduction
Date: June 4, 2024
Dear Sir/Madam, On behalf of the Dobra Družba organization, we are addressing you with a request to establish a model for regulating sex work in Croatia. As a marginalized group of citizens and economic migrants, we want clarity regarding our rights and obligations. We are not asking for charity or privileges, but for recognition and definition of our work, as well as inclusion in the decision-making process that affects our lives.
We are aware that prostitution is prohibited, but that does not mean it is not practiced, especially among people who are in a difficult situation and cannot find another solution. Such persons can easily become victims of human traffickers. We have several good ideas and ways to direct persons from prostitution towards legal forms of sex work in Croatia.
Need for Clear Definitions and Legislation
It is necessary to define all undefined and outdated interpretations of laws related to sex work. When discussing sex work, making decisions, or touching on this topic in any way, it is essential that sex worker organizations be invited to the discussion. Speaking on our behalf without our participation has so far brought bad and unrealistic solutions that do not reflect the actual needs and conditions in our community.
Space for Work and Health Services
We want to know where we can legally perform our work and where not. In addition, we are looking for clear guidelines regarding the use of health services – what belongs to us and what services we are entitled to.
Definition of Sex Work
It is important that sex work is precisely defined to avoid future misunderstandings. This definition should include all aspects of our work and be aligned with the needs and rights of sex workers.
Legal Forms of Sex Work
Most genres of sex work are allowed but not regulated. This includes: Sensual massages (without lingam massage), Erotic/exotic dancers, Fetish session performers, Adult content creators, Escorts, Cuddlers.
We especially want to emphasize the need to think in the direction of sexual assistants (for persons with dysfunctions) and sexual surrogates (workers in psychosocial support).
Participation in Court Matters
We want to participate in court proceedings concerning sex work, because only in this way can we ensure that decisions are fair and based on the actual situation. Our safety and transparency of work are of key importance, and we want to establish mechanisms that will enable this.
Conclusion
Every day that we do not resolve issues of sex work, we enable the creation of new victims, for which those who ignore or are empathetic towards this marginalized group are responsible.
If you have additional proposals, please contact us and be part of the change!
Awaiting your response and constructive cooperation, we cordially greet you.
Sincerely,
Advocate for Sex Workers' Rights in the Balkans
